These Terms of Service ("Terms") govern your use of BCL Production, including voting for contestants, tipping, entering campaigns, purchasing event tickets, and booking tours. By using this site, you agree to these Terms. If you do not agree, please do not use the site.
1. Eligibility
You must be at least 18 years old to make a payment on this platform (voting, tipping, buying tickets, or paying a campaign entry fee), and to use the phone number and M-Pesa account you provide, which must be registered in your own name or one you are authorized to use.
2. Accounts
Some features (entering a campaign, buying tickets, listing an event) require an account. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. One account per person — creating multiple accounts to manipulate voting or campaign entries is prohibited.
3. Payments, Votes, Tips, and Tickets
- All payments are processed via M-Pesa (Safaricom Daraja API). By submitting a payment, you authorize the exact amount shown to be charged to the phone number you provide.
- Votes and tips are added to a contestant only once Safaricom confirms the payment was successful.
- All payments — votes, tips, ticket purchases, and campaign entry fees — are final and non-refundable once confirmed by Safaricom, including where a campaign entry is subsequently not approved. If you believe you were charged in error, contact us and we will investigate.
- We do not guarantee that any contestant will win a campaign, and votes/tips are not redeemable for cash or any other consideration.
- Event tickets are subject to the terms of the individual event listing (venue, date, and any conditions stated by the organizer).
4. Campaign Entries and Event Listings
Campaign entries and event listings submitted through the platform are reviewed by our team before being published. We may approve, reject, or request changes to any submission at our discretion, including for content that violates these Terms.
5. Prohibited Conduct
You agree not to:
- Use bots, scripts, or automated tools to submit votes, tips, or payment requests.
- Attempt to circumvent any rate limiting, security, or anti-fraud measure on the site.
- Submit payment requests targeting a phone number that is not your own, or use the platform to harass another person (including repeatedly triggering M-Pesa payment prompts on someone else's phone).
- Upload content that is unlawful, defamatory, obscene, or infringes someone else's rights.
- Attempt to gain unauthorized access to any part of the site or its underlying systems.
We may suspend or terminate accounts that violate these Terms.
6. Content You Submit
You retain ownership of photos, bios, videos, and other content you submit. By submitting it, you grant BCL Production a non-exclusive license to display it on the platform (and in related promotion of the campaign or event it belongs to) for as long as it remains published.
7. Disclaimers
The platform is provided "as is." We do not guarantee uninterrupted availability, and we are not responsible for delays or failures caused by M-Pesa/Safaricom network issues outside our control. While we take reasonable steps to confirm payments accurately and promptly, you should keep your M-Pesa confirmation message as proof of any transaction.
8. Limitation of Liability
To the fullest extent permitted by Kenyan law, BCL Production is not liable for indirect, incidental, or consequential damages arising from your use of the platform. Our total liability for any claim relating to a specific transaction is limited to the amount of that transaction.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of the Republic of Kenya.
